These Terms of Service ("Terms") govern your access to and use of brokenwindow.ai, including the game Barons of Steel and all related services (together, the "Service"), operated by Broken Window LLC, a Delaware limited liability company ("Broken Window," "we," "us").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with the consent of a parent or guardian who agrees to these Terms on your behalf.
You may not use the Service if you have previously been banned, or if doing so would violate laws applicable to you.
2. Your Account
You are responsible for your account and everything that happens under it. Keep your credentials secure and notify us immediately of any unauthorized use. You may not sell, transfer, share, or lend your account to anyone else. One account per person.
We may suspend or terminate your account if you violate these Terms, and we reserve the right to refuse service to anyone.
3. License to Use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own entertainment. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service except as permitted by law.
4. Shards (Virtual Currency)
The Service includes a virtual currency called "Shards." Read this section carefully — Shards are not money.
(a) No cash value. Shards have no monetary value and are not currency, funds, stored value, or property of any kind. They exist only as units of account inside the Service.
(b) Earn-only; no purchases. Shards can only be earned through gameplay and participation in the Service. Shards cannot be purchased with money or anything else of value.
(c) No redemption. Shards cannot be redeemed, exchanged, or cashed out for money, cryptocurrency, goods, or anything of value outside the Service, under any circumstances.
(d) No transfers. Shards cannot be sold, traded, gifted, or transferred between accounts. Any attempt to buy or sell Shards outside the Service is a violation of these Terms and grounds for termination.
(e) License, not property. Your Shard balance is a limited license feature of the Service, not an asset. Shards have no existence outside the Service.
(f) We may modify or revoke. We may change how Shards are earned or spent, adjust balances to correct errors or abuse, expire Shards, or discontinue Shards entirely, at any time without compensation.
(g) Forfeiture. All Shards are forfeited without compensation when your account is terminated for any reason.
5. Subscriptions
Some features may require an active subscription paid in Shards.
(a) Price and term. A subscription costs 1,000 Shards per 30-day period. We may change subscription pricing with notice; changes apply from your next renewal.
(b) Auto-renewal. Subscriptions renew automatically at the end of each 30-day period, deducting the subscription cost from your Shard balance, until you cancel. You can cancel at any time from your account settings, and cancellation takes effect at the end of the current period.
(c) Insufficient balance. If your Shard balance is insufficient at renewal, we may at our discretion provide a grace period before your subscription lapses. The length and availability of any grace period is determined by us and may change.
(d) No refunds. Because Shards have no cash value, no refunds are payable. Shards deducted for a completed or in-progress subscription period are not returned.
6. Leaderboard Competitions and Prizes
We may run periodic (e.g., monthly) leaderboard competitions.
(a) Prizes are Shards. Competition prizes are awarded exclusively as Shards credited to the winner's account. Prizes have no cash value, no cash alternative, and are subject to the Shards terms in Section 4 in full.
(b) Skill-based; free to enter. Competitions are contests of skill based on gameplay performance. No purchase or payment of any kind is necessary to enter or win.
(c) Fair play. We may disqualify any participant and withhold or reverse prizes for cheating, botting, collusion, use of multiple accounts, exploitation of bugs, or any manipulation of a competition. Our decisions on competition results are final.
(d) Not gambling. Entry requires no payment, Shards cannot be purchased or redeemed for value, and outcomes are determined by skill. Nothing in the Service constitutes gambling, wagering, or a lottery.
(e) Changes. We may modify, suspend, or cancel any competition at any time, including adjusting prize amounts and schedules.
7. Code of Conduct
You agree not to:
- Cheat, use bots, scripts, automation, or unauthorized third-party software to interact with the Service
- Exploit bugs or unintended behavior for advantage (report them instead via the contact details below)
- Attack, probe, scrape, overload, or interfere with the Service or its infrastructure
- Harass, threaten, or abuse other users, or post unlawful, hateful, or infringing content
- Impersonate others or misrepresent your affiliation
- Buy, sell, or trade accounts, Shards, or in-game assets for real-world value
- Use the Service for any unlawful purpose
We may investigate violations and take any action we consider appropriate, including balance adjustments, competition disqualification, suspension, or permanent bans.
8. User Content
If you submit content to the Service (usernames, profile content, or similar), you retain ownership but grant us a worldwide, royalty-free license to host, display, and use it in connection with operating and promoting the Service. You are responsible for your content. We may remove content that violates these Terms.
Note that player profiles, usernames, and leaderboard standings are public and visible to anyone, including non-registered visitors.
9. Intellectual Property
The Service, including Barons of Steel, all game content, code, artwork, trademarks, and the Shards system, is owned by Broken Window LLC or its licensors and is protected by intellectual property laws. Except for the limited license in Section 3, no rights are granted to you.
10. Third-Party Services
The Service relies on third-party providers (such as hosting and email delivery). We are not responsible for third-party services, and your use of them may be subject to their own terms.
11. Availability, Changes, and Termination of the Service
The Service is provided on an "as available" basis. We may modify, suspend, or discontinue any part of the Service — including game mechanics, Shards, subscriptions, and competitions — at any time. We will make reasonable efforts to give notice of material changes but are not obligated to maintain any feature. We are not liable for any modification, suspension, or discontinuation, including any loss of Shards or in-game progress.
You may stop using the Service and delete your account at any time.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROKEN WINDOW LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, SHARDS, OR IN-GAME PROGRESS, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Nothing in these Terms excludes liability that cannot be excluded by law, including under mandatory consumer protection rules in your country of residence.
14. Indemnification
You agree to indemnify and hold harmless Broken Window LLC from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware. You and Broken Window each waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at the address below with the subject line "Arbitration Opt-Out." Small-claims matters and claims for injunctive relief relating to intellectual property or unauthorized access are excluded from arbitration.
If you are a consumer in the EU, UK, or another jurisdiction with mandatory local consumer protections, nothing in this section deprives you of the protection of those rules or of your right to bring proceedings in your local courts where the law grants it.
16. Changes to These Terms
We may update these Terms from time to time. For material changes we will give notice through the Service or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
17. General
These Terms are the entire agreement between you and Broken Window LLC regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
